Contract Payment/Dispute Resolution

This class will identify various payment and dispute resolution provisions contained in the construction industry's form contracts and private contracts.  Special attention will be given to how various payment clauses can impact timely payment for base contract work and extras.  We will also examine alternative dispute resolution provisions for mediation, arbitration and litigation.  We will identify which clauses are to be avoided and which alternative dispute clauses are fair and effective.  Finally, we will examine the Michigan Builders Trust Fund Act - MCLA 570.151.  We will teach you how this Act is violated and how to avoid liability.

Payment Bonds

In public work projects, there are no construction liens.  Payment bonds are furnished by the contractor to the owner to protect payment to the subcontractor and supplier.  In this nuts and bolts workshop you will learn what the necessary steps are to establish a claim against the payment bond.  You will also learn the critical time periods, how a bond claim is enforced, and how a claim can still be valid if a time period is missed.  Since so much of the current work in Southeast Michigan is public and governmental, this workshop is critical.

Prevailing Wage Compliance

You should attend this session if you are a small contractor bidding ARRA (Recovery Act), MDOT Highway, Schools, University, and Heavy Construction Projects.  This introduction to Prevailing Wage will cover Michigan’s Prevailing Wage Act 166, as well as the Federal Davis-Bacon Act, wage determinations, worker classifications, fringe benefit credits, and contractor responsibilities.
